SUGGESTED WAYS TO SELECT A MEDIATOR Parties to a dispute may save ADR forum filing fees and administrative fees by using one of the following methods of selecting a mediator. However, if you feel that the structure provided by an ADR forum would be helpful to resolving your dispute, then be sure to included an "associations" selection in your mediator search. 1) Use You Draw Straws to help make your mediator selection 2) Have a respected third party select your mediator for you. 3) Have your attorney and the other party's attorney select the mediator (This is usually possible). 4) Have each side to the dispute select a certain number of choices for mediator (say 5, 7, or 9), then let each side strike through a certain number of the other side's choices (say 3, 5, or 7). Then place the remaining names in a hat, and have someone draw one out. That name is your mediator! (It is recommended that you have an alternative selected also in case the first choice has scheduling or other conflicts and cannot serve). 5) Have each side to the dispute select a person (from Mediator.com or Arbitration.com E- Directories of alternative dispute professionals).
